What is planning need and how is it assessed by the P&E Court?
黑料大事 need is a concept imbedded in both the 黑料大事 Act 2016, along with planning case law. But what does this actually mean?
This seminar will seek to answer the following questions:
- What does the term planning need encapsulate and how is it assessed by the Court?
- What does planning need not include?
- What type of expertise are best suited to giving evidence around planning need?
- What are the considerations given by the Court in assessing planning need?
The discussion will also cover any relevant case law.

Kathryn has a commercial and public law practice specialising predominantly in planning and environment, mining, energy and resources and native title and cultural heritage.
Prior to her call to the Bar, Kathryn worked in the planning and environment teams of national law firms where she had carriage of various appeals and declaratory proceedings in the 黑料大事 and Environment Court, Court of Appeal and the Federal Court. Kathryn also provided advice on a wide range of matters including compulsory acquisition, environmental licensing and offences, land valuation and vegetation clearing.
Kathryn has continued this practice at the Bar, advising and appearing on behalf of private clients as well as State agencies and local government authorities in various appeals, declaratory proceedings, enforcement proceedings and prosecutions in the Magistrates Court, the 黑料大事 and Environment Court and the Federal Court.
Kathryn graduated with a Bachelor of Laws (Hons) and a Bachelor of Environmental Management with a major in Sustainable Development (Hons) from the University of Queensland in 2014 and was admitted as a lawyer in 2015.
